1. Definitions
“Seller” refers to Power Pallets (A. Cornish Trading as Power Pallets) 
“Buyer” refers to any person, company or entity purchasing goods or services from PP.
“Goods” refers to pallets and any associated materials supplied by PP.
“Services” includes delivery, collection, repair or refurbishment services offered by PP.

2. Acceptance of Terms
By placing an order, the Buyer agrees to these Terms of Trade, which apply to all transactions unless otherwise agreed in writing.

​

3. Payment Terms
All orders must be paid in full before delivery, unless prior credit arrangements are made.
Prices are quoted in NZD and are exclusive of GST unless stated otherwise.
Late payments may incur interest at 2% per month and collection costs.

​

4. Delivery and Risk
Risk in the goods passes to the Buyer upon delivery or collection.
PP will use reasonable efforts to meet delivery times but accepts no liability for delay.
Delivery is to kerbside only unless otherwise agreed.

​

5. Title and Ownership
Title in the goods remains with PP until payment is received in full.
If the Buyer sells or uses the goods before payment is completed, the proceeds must be held in trust for PP.

​

6. Product Condition and Use
Pallets sold by PP may be new, used, or refurbished.
Used pallets are sold “as-is” unless otherwise stated.
It is the Buyer’s responsibility to inspect all goods prior to use and determine their fitness for purpose.

7. Limitation of Liability
To the maximum extent permitted by New Zealand law:
PP shall not be liable for any loss, damage, injury, or death caused by the use, misuse, failure, or collapse of any pallet or goods supplied.
The Buyer accepts full responsibility for ensuring the safe and appropriate use of all pallets, including weight limits, stacking, and handling.
PP shall not be liable for indirect or consequential losses, including loss of business or income.
If PP is found liable for any reason, liability is strictly limited to the purchase price of the goods supplied.

8. Warranties
PP provides no warranty for second-hand goods.
For new pallets, warranties (if any) are limited to those provided by the manufacturer.
Any claims must be made within 7 days of delivery.

​

9. Returns and Refunds
No returns or refunds will be accepted for used or custom pallets.
Returns for new pallets are subject to a 20% restocking fee and must be approved in writing.

​

10. Indemnity
The Buyer agrees to indemnify and hold harmless PP, its employees, contractors, and agents against any and all claims, damages, or expenses arising from:
Use or misuse of goods,
Failure to follow safety instructions,
Storage or handling practices outside standard pallet industry norms.

​

11. Governing Law
These terms are governed by the laws of New Zealand.
Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

12. Amendments
PP reserves the right to amend these terms at any time. Changes will be effective once published on this website.
